Addendum: Gustosfera Promotional Offer Addendum Terms
This Addendum sets out the additional terms and conditions applicable to the promotional offer under which an eligible user may receive one (1) free Gustosfera (https://gustosfera.com) "Yearly Fixed Plan (Country)" with the purchase of an eligible MathYug membership. This Addendum supplements and forms part of MathYug's main Terms and Conditions. In the event of any conflict or inconsistency between this Addendum and the main Terms and Conditions, this Addendum shall prevail only to the extent of such conflict and only with respect to this promotional offer.
Definitions:
For the purpose of this Addendum, the term "Promotional Offer" refers to the offer of one (1) free Gustosfera "Yearly Fixed Plan (Country)" made available by MathYug and/or Gustosfera to eligible users subject to these Addendum terms. The term "Eligible User" refers to a user who satisfies all conditions of this Addendum, the main Terms and Conditions of MathYug, and any applicable Gustosfera terms. The term "Linked Account" refers to the Gustosfera account registered with the same email address as the email address associated with the user's active MathYug membership.
Offer Availability:
This Promotional Offer is available for a limited period only and/or while stocks last, as determined solely by MathYug and/or Gustosfera. MathYug and/or Gustosfera reserve the right to modify, suspend, withdraw, discontinue, or terminate this Promotional Offer at any time, with or without prior notice.
Eligibility:
This Promotional Offer is available to both new and existing holders of an active MathYug membership, subject to verification and compliance with all applicable terms. Purchase, possession, renewal, or continuation of a MathYug membership does not automatically guarantee eligibility for this Promotional Offer.
One Plan Per Account:
This Promotional Offer is available strictly on a one plan per account basis. Even if a user purchases, holds, renews, or becomes entitled to multiple MathYug memberships, whether simultaneously or consecutively, the user shall not be entitled to receive more than one free Gustosfera "Yearly Fixed Plan (Country)" for the same Gustosfera account under this Promotional Offer, unless explicitly stated otherwise by MathYug and/or Gustosfera.
Account Registration and Email Matching:
To be eligible for this Promotional Offer, the user must register a Gustosfera account using the same email address that is associated with the user's active MathYug membership. The Promotional Offer shall be linked only to that Gustosfera account. If the email address on the Gustosfera account does not match the email address associated with the user's active MathYug membership, the user may be disqualified from this Promotional Offer.
It is solely the user's responsibility to ensure that the email address used on MathYug and Gustosfera is true, accurate, current, complete, and matching. MathYug and Gustosfera shall not be responsible for any loss of eligibility, failed activation, delayed activation, rejection, or other issue resulting from incorrect, mismatched, incomplete, inaccessible, or outdated email information.
Activation Process:
Under this Promotional Offer, the eligible user's Gustosfera account may be credited with sufficient promotional reward points in the account's rewards wallet to enable the user to use the Gustosfera "Yearly Fixed Plan (Country)" without making any separate payment, subject at all times to the linked MathYug membership remaining active and in good standing. The relevant Gustosfera "Yearly Fixed Plan (Country)" may also be activated on the eligible user's Linked Account accordingly.
Such promotional reward points are issued solely for the purpose of this Promotional Offer, have no cash value, cannot be withdrawn, transferred, refunded, or exchanged, and may be used only in the manner permitted by Gustosfera and/or MathYug under this Promotional Offer.
Validity:
The benefit of the free Gustosfera "Yearly Fixed Plan (Country)" under this Promotional Offer shall remain available only until the expiry of the linked MathYug membership, regardless of the use of the term "Yearly" in the plan name. The promotional reward points credited under this Promotional Offer shall remain valid and usable only while the linked MathYug membership remains active and in good standing.
Immediately upon the expiry, cancellation, suspension, termination, revocation, or banning of the linked MathYug membership or MathYug account, all unused or remaining promotional reward points credited under this Promotional Offer shall automatically expire, become null and void, and shall no longer be available for use, redemption, adjustment, refund, or compensation.
For the avoidance of doubt, such expiry or nullification shall occur automatically and without any requirement of prior notice to the user.
Termination of Promotional Benefit:
If the user's linked MathYug membership expires, is cancelled, is terminated, is suspended, is revoked, becomes inactive, or if the user's MathYug account is banned, restricted, or disabled for any reason, then the Promotional Offer, the free Gustosfera plan, and/or any related promotional reward points may be terminated, suspended, revoked, or expired immediately without any refund, replacement, compensation, liability, or obligation on the part of MathYug and/or Gustosfera.
Non-Transferability:
This Promotional Offer is personal to the Eligible User and is non-transferable. The Promotional Offer, related reward points, activation benefit, gift card, or free Gustosfera plan cannot be sold, assigned, transferred, shared, merged, bartered, or otherwise made available to any other user, account, or person.
Non-Refundable and Non-Exchangeable:
This Promotional Offer, including but not limited to the free Gustosfera "Yearly Fixed Plan (Country)," any promotional reward points, activation benefit, coupon, gift card, or related credit, is non-refundable, non-cancellable, and non-exchangeable. It cannot be exchanged for cash, refund, credit, any other Gustosfera plan, any other Gustosfera service, or any MathYug course, service, or membership. No substitution, replacement, or compensation shall be provided except where required by applicable law.
Gift Card / Email Communication:
Where applicable, an activation gift card, coupon code, offer communication, or activation-related email may be sent to the user within ten (10) days from the date of purchase of a new eligible MathYug membership. MathYug and/or Gustosfera do not guarantee delivery within any exact time and shall not be liable for delays caused by technical issues, email failures, spam filtering, incorrect user information, or other circumstances beyond reasonable control.
If the user does not receive the applicable activation communication within ten (10) days from the date of purchase of a new eligible MathYug membership, the user must contact MathYug Support using the official support channel. Failure to contact support within a reasonable time may result in delay, rejection, lapse, or inability to process the Promotional Offer.
Existing Users and New Users:
This Promotional Offer may be made available to both existing MathYug membership holders and newly purchasing MathYug membership holders, subject to availability, verification, eligibility, and any additional conditions communicated by MathYug and/or Gustosfera from time to time.
Use of Gustosfera Services:
The use of Gustosfera accounts, plans, wallet balances, reward points, websites, features, products, and/or services shall at all times remain subject to Gustosfera's own applicable terms, conditions, policies, technical limitations, fair usage rules, pricing rules, account rules, and service restrictions. This Addendum does not grant the user any right beyond what is expressly stated in this Promotional Offer.
Fraud, Abuse, and Verification:
MathYug and/or Gustosfera reserve the right to verify the identity, account ownership, membership status, email matching, and eligibility of any user at any time. Any misuse of this Promotional Offer, duplicate claim, false information, fake account, mismatched email address, abuse of systems, circumvention of the one-plan-per-account rule, or breach of MathYug and/or Gustosfera terms shall result in rejection, suspension, cancellation, or withdrawal of the Promotional Offer and/or associated account benefits without refund or compensation.
No Guarantee:
MathYug and/or Gustosfera do not guarantee that every MathYug membership purchase will qualify for this Promotional Offer, that the offer will remain available at all times, or that activation will occur in every case. Availability of this Promotional Offer is subject to stock, technical feasibility, eligibility verification, account compliance, and discretionary approval where applicable.
Limitation of Liability:
Without prejudice to the main Terms and Conditions, MathYug and/or Gustosfera shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, technical, commercial, or other loss arising out of or in connection with this Promotional Offer, including but not limited to delay in activation, non-delivery of email, email mismatch, ineligibility, withdrawal of offer, expiry of reward points, plan termination due to linked membership status, technical failures, or account suspension or banning.
Final Decision:
In the event of any dispute, confusion, ambiguity, technical issue, verification issue, eligibility issue, account mismatch, or interpretation regarding this Promotional Offer, the decision of MathYug and/or Gustosfera shall be final and binding.
Modification of Addendum:
MathYug and/or Gustosfera reserve the right to modify, update, amend, or withdraw this Addendum at any time without prior notice. The continued use of MathYug and/or Gustosfera services after such modification shall constitute acceptance of the updated Addendum terms.
